1. Scope and Definitions

This Refund Policy (“Policy”) governs refund requests related to credits or other paid features (“Credits”) purchased for use within the applications (“Apps”) provided by Chevvi Pty Ltd (the “Company,” “we,” “us,” or “our”). By purchasing Credits and/or using our Apps, you agree to be bound by this Policy, as well as our Terms of Use and Privacy Policy.

Important Note: All purchases of Credits for our Apps are exclusively made through Apple’s App Store. Apple retains the ultimate authority in issuing refunds in accordance with its own refund policies.

2. Eligibility for Refunds

  1. Unused Credits: Refunds are available solely for purchases of Credits that remain completely unused. To qualify as “unused,” no portion of the Credits may have been applied toward any feature or transaction within the Apps.
  2. Partial or Full Usage: If any portion of a purchased Credit is utilized—even partially—the purchase shall be deemed final and non-refundable. Once you have started using your Credits, no refunds will be issued for any reason, except as otherwise required by applicable law or Apple’s refund policy.
  3. Apple’s Role: Refund decisions for any purchase made through the Apple App Store are ultimately determined by Apple, in accordance with its refund policy. The Company will facilitate the process by providing Apple with necessary personal data to evaluate and process any refund request.

3. Company’s Facilitation and Right to Recommend

  1. Data Sharing with Apple: The Company will, upon Apple’s request, share specific personal data (outlined in Section 4 below) to help Apple review and process your refund request.
  2. Recommendation to Apple: In the event you have violated any of the Company’s policies (e.g., Terms of Use), the Company reserves the right to recommend that Apple deny your refund request. However, the final decision remains solely with Apple.

4. Personal Data Shared with Apple

  1. To facilitate the refund process, you hereby consent to the transmission of certain personal data to Apple. This personal data includes, but is not limited to:
    • Time elapsed since app installation
    • Total app usage time
    • Anonymous account identifier
    • Confirmation of successful credit delivery
    • Indication of whether purchased Credits were partially or fully consumed
    • Information on whether the in‑app purchase included a trial period (e.g., free Credits offered as an introductory trial)
    • Total amount spent
    • Total amount refunded (if any)
  2. This data transfer is conducted in compliance with Apple’s guidelines for the Send Consumption Information API and is solely for assisting Apple in the review and processing of refund requests.
  3. By using our Apps, you provide valid, informed, and unambiguous consent for such data sharing. If you wish to withdraw your consent, you must immediately cease using our Apps and delete your account. Continued use of our Apps constitutes ongoing acceptance of this data-sharing provision.

5. Additional Disclaimers

  1. Local Consumer Laws: This Policy is subject to any local consumer laws or regulations that may provide you with additional rights or remedies. To the extent that any applicable law conflicts with the terms of this Policy, such law shall supersede the conflicting provisions only to the extent of such conflict.
  2. No Guarantee of Refund: Except as expressly stated in this Policy, or as required by Apple or applicable law, we make no guarantee that a refund will be issued for any purchase. Decisions regarding eligibility for refunds through the Apple App Store are made solely by Apple.

6. Acceptance of Terms

  1. Condition of Use: Your use of our Apps is conditional upon your agreement to this Policy. By continuing to use the Apps, you acknowledge that you have read, understood, and agree to be bound by this Policy.
  2. Non-Acceptance: If you do not agree with the terms of this Policy, you must cease using our Apps and delete your account. Any continued use of our Apps following any modifications to this Policy constitutes acceptance of those modifications.

7. Amendments

  1. We reserve the right to modify or amend this Policy at any time. Any changes will be effective immediately upon posting within our Apps or by other means of notification.
  2. Your continued use of our Apps after any modifications constitutes acceptance of the updated Policy. If you do not agree with any changes, you must discontinue your use of our Apps and delete your account.

8. Governing Law and Dispute Resolution

This Policy and any dispute arising out of or related to it or its subject matter shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated (unless otherwise required by applicable law). You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for the resolution of any disputes. Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or restrain breach of this Policy.
